Learned counsel representing the Appellant submits that he wishes to withdraw the present appeal, as the same had been preferred to challenge the interlocutory order dated 30.08.2024 passed by the Executing Court in Ex. No.309/2021. It is submitted that the aforesaid Execution Petition itself has been dismissed for non-prosecution. 3.

Keeping in view the aforesaid position, the appeal is dismissed as withdrawn, with liberty to file application for revival if the cause for continuing the present appeal survives.
