The appellant has assailed preliminary decree of outstanding rent, which was passed under Order XII Rule 6 CPC. The original rent was Rs. 90,000/- per month admittedly by way of written lease deed. According to the case set up by the appellant, on account of covid pandemic the parties had orally reduced the rate of rent to Rs. 50,000/-, which stand was denied by the respondent.

After addressing partly, learned counsel for appellant on instructions, seeks permission to withdraw this appeal with liberty to file review application before the learned Trial Court on the issue of observation in para 8 of the impugned judgment that Rs. 50,000/- per month is outstanding. 3.

Accordingly, the appeal and accompanying applications are dismissed as withdrawn with liberty as sought.
