% 08.03.2017 Issue notice. Ms. Roy accepts notice on behalf of the State. Respondent No.2 is present in Court and he accepts notice. He is identified by the I.O., who is also present in Court.
The petitioners have preferred the present writ petition to seek quashing of FIR No.45/2017 dated 31.01.2017 under section 308/ 506/ 34 IPC registered at PS - Vikaspuri against the petitioners on the complaint of respondent No.2, who is also the victim.
The petitioners are all present in Court and they express regret about their conduct. They have assured the Court that they shall not resort to violence in future and they are ready & willing to atone for their conduct. They further state that they shall also bear the liability towards the medical
treatment of respondent No.2.
Respondent No.2, who is the victim and the complainant states that in view of the undertaking given by the petitioners that they shall not cause any harm or injury to respondent No.2 in future and they shall also bear the liability in respect of medical treatment of the respondent No.2, he also joins the prayer for quashing of the FIR in question. He further states that he has made this statement out of his own free will and accord and without their being any force or coercion.
In view of the aforesaid, subject to each of the petitioners depositing Rs.25,000/- in the Prime Minister's National Relief Fund and subject to their directly clearing the medical bills of respondent No.2 in respect of his treatment being received at the Family Hospital, CRPF Camp, Tilak Vihar, Vikaspuri, the FIR in question and the proceedings arising therefrom are quashed. The petitioners shall deposit the amount of Rs.25,000/- each in the Prime Minister's National Relief Fund within four weeks, and shall also clear the hospital bills of the respondent No.2 within one week of the bills being raised. Upon receipt of the deposit of the amount in the Prime Minister's National Relief Fund and clearance of all the bills, the FIR and the proceedings arising therefrom shall be quashed. Dasti.
