O R D E R

% 14.03.2016 The present writ petition has been filed challenging respondent no. 1-University's circular dated 04th March, 2016directing the petitioner not to initiate any action for charging enhanced fee from the students.

In the writ petition, it has been averred that the enhanced fee is being charged in accordance with the recommendation of the Fee Regulatory Committee and as notified by Lt. Governor and Govt. of NCT of Delhi vide notification dated 19th February, 2016 for the Academic Years 2014-17, 2014-18 and 2014-19.

At the outset, learned counsel for respondent Nos. 2 and 3 has

handed over a notification dated 10th March, 2016 by virtue of which the notification dated 19th February, 2016 has been rescinded. The relevant portion of the notification dated 10th March, 2016 is reproduced hereinbelow:- "Considering the fact that thousands of students have been affected by the revision of the fee with retrospective effect, the Government of National Capital Territory of Delhi rescinds the aforesaid Gazette Notification No. DHC 4(68)/SFRC/14-15/9728 dated 19.02.2016."

In view of the aforesaid, learned counsel for the petitioner wishes to withdraw the present writ petition and application with liberty to file a fresh writ petition challenging the notification dated 10th March, 2016 and respondent no. 1-University's circular dated 04th March, 2016.

With the aforesaid liberty, the present writ petition and application stand disposed of.
