O R D E R
% 08.03.2025 Appellant insurance company has filed an appeal for reduction of the award dated 21.12.2016 passed by the Learned MACT, awarding a compensation of Rs. 13,33,905/- along with interest @ 8% p.a. from the date of filing of claim petition. On appeal, the insurance company was directed to deposit entire awarded amount with up to date interest in terms of the order dated 10.03.2017 passed by this Hon'ble Court before the tribunal and 40% of the deposited amount was directed to be released to R-1 in terms of the order dated 05.07.2017 passed by this Hon'ble High Court We have interacted with the learned Counsel/parties concerned. Apropos such interaction and due deliberation, it is agreed between the parties that out of the deposited amount, along with accrued total interest, a lump sum amount of Rs.
1,00,000/- be refunded to the insurance company and balance amount in terms of the settlement The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
along with accrued interest after adjusting the amount to be refunded to the insurance company and after adjusting the amount already released to the claimants, shall go to the respondents/claimants. In view of the above settlement, the concerned Tribunal is directed that lump sum amount of Rs.1,00,000/- be refunded to the insurance company. The balance amount remaining deposited with the concerned Tribunal in terms of the settlement after adjusting the lump sum amount of Rs.1,00,000/- shall be released to the respondent(s)/claimant(s) subject to the compliance of all the requisite formalities.
The statutory amount deposited as a pre-condition for filing appeal with interest, if any, be refunded to the Insurance Company. The present appeal alongwith the pending application(s), if any, is disposed of with directions in terms of the foregoing settlement. A copy of this order be sent to concerned Ld. Tribunal with LCR, if requisitioned and received.
