% 29.11.2017 After some hearing the learned counsel for the respondents, who are plaintiffs before the court of Additional District Judge fairly concedes that the petition may be allowed and the impugned order may be set aside and the written statement of the petitioner allowed to be taken on record condoning the delay.

The delay in filing the written statement is condoned. The order striking off the defence of the petitioner is set aside. The written statement shall be taken on record by the learned Additional District Judge on the next date, when it shall be presented.
