IN THE HIGH COURT OF DELHI AT NEW DELHI
+ CRL.M.C. 1776/2018 & Crl. M.A. No. 6380/2018 MOHD ALI @ SONU & ORS ..... Petitioners Through Mr. Vijay Pal, Adv.
versus THE STATE GOVT OF NCT OF DELHI & ORS .... Respondents Through Ms. Manjeet Arya, APP with SI Tejveer, P.S. Welcome Respondent no. 2 in person
CORAM:
HON'BLE MR. JUSTICE A.K. PATHAK
O R D E R
% 11.04.2018 Notice.
Learned APP accepts notice for respondent no. 1.
Respondent no. 2 Ms. Meena is present in Court and accepts notice. Respondent no. 2 has been identified by SI Tejveer of Police Station Welcome.
It is submitted that husband (petitioner no.1) and wife (respondent no.
2) are living together after settling their disputes amicably before Delhi Mediation Centre, Karkardooma Courts, Delhi on 7th August, 2012; therefore, FIR No. 531/2006 under Sections 498-A/406/34 IPC and Sections 3/4 of the Dowry Prohibition Act, 1961 registered at Police Station
Welcome on the complaint of respondent no. 2 and the consequent proceedings emanating therefrom may be quashed. Respondent no. 2 submits that she has settled the matter with the petitioner no. 1 of her own free will and without any undue force, pressure or coercion. Respondent no. 2 further submits that presently she is living with petitioner no. 1 and has no objection in case FIR is quashed against the petitioner no.1 and his relatives, that is, petitioner nos. 2 to 6.
Keeping in mind that husband and wife have started living together after resolving their differences, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, FIR No. 531/2006 under Sections 498-A/406/34 IPC and Sections 3/4 of the Dowry Prohibition Act, 1961 registered at Police Station Welcome and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous. Dasti.
