O R D E R

% 30.01.2018 Respondent no.2 is present in Court along with her counsel. She submits that she has settled the matter with the petitioner no.1 vide Compromise Deed dated 15th October, 2005 of her own free will and without any undue force, pressure or coercion. She has admitted her signatures on the photocopy of the compromise deed at point 'X'. It is submitted that original compromise deed was filed before the trial court in divorce case. Respondent no.2 further submits that her marriage with petitioner no.1 has already been dissolved by a decree of divorce by mutual consent dated 3rd January, 2007 passed by the Additional District Judge in a HMA No. 53/2006 tilted Smt. Sugna Devi Vs. Amit Kumar. Respondent no.2 submits that she has no objection if the Complaint Case No. 6586/2016

(old 341/2006) tilted Sugna Devi Vs. Amit Kumar pending before the learned Metropolitan Magistrate, North-West, Rohini, Delhi is quashed. Affidavit of respondent no.2 is also on record wherein she has stated that she has no objection in case the aforementioned complaint case is quashed. In view of the compromise arrived at between the petitioner no.1 and respondent no.2 voluntarily, in the interest of justice, afore-mentioned complaint case is quashed.

Petition is disposed of in the above terms.
