O.M.P.(I) (COMM.) 136/2018 The learned counsel for the petitioner submits that the Arbitral Tribunal has been duly constituted by the petitioner by way of its notice dated 23rd April, 2018. The learned counsel for the petitioner further submits that the Arbitrator has, however, still not entered upon the reference. Be that as it may, as the Arbitral Tribunal has already been constituted, the present petition is disposed of granting liberty to the petitioner to file an appropriate application under Section 17 of the Arbitration and Conciliation Act, 1996 before the Arbitrator, if so required. The petition is accordingly disposed of.
