The petitioners seek quashing of FIR No. 135 of 2011 under Sections 365/34 of the IPC registered at Police Station Burari, New Delhi, based on a settlement.

The dispute is inter-se family members. Petitioner no. 1 is mother of respondent no. 3. Petitioner nos. 2 and 3 are brothers of respondent no. 3. Respondent no. 2 is husband of respondent no. 3. The subject FIR emanates out of the dispute which took place between the family members. Relations were strained on account of respondent no. 2 and 3 getting married without permission of the elders in their family.
It is contended that with the intervention of senior members of the family, the parties have settled their disputes. Compromise deed has been executed between the parties on CRL.M.C. 1675/2018

Respondent no. 2 & 3 are present in person in Court today and are identified by the Investigating Officer. They submit that they have settled the disputes with the intervention of senior members of their family. Respondent No. 2 & 3 further submit that they do not wish to press the criminal complaint against the petitioners any further. 4.
In view of the fact that the disputes between the parties, who are family members, have been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would also be expedient to quash the subject FIRs and the consequent proceedings emanating therefrom.

In view of the above, the petitions are allowed. FIR No. 135 of 2011 under Sections 365/34 of the IPC registered at Police Station Burari, New Delhi and the consequent proceedings emanating therefrom are, accordingly quashed.
