Plaintiff has filed the present Suit seeking a declaration and decree, order or partition that the Plaintiff has 1/5th share in the suit property mentioned in the Schedule to the Plaint.

It is stated by the Plaintiff, who is present in Court today, that he wishes to abandon his claim under the Suit and seeks permission to withdraw the present Suit.

Even though an application under Order 23 Rule 1(3) of the CPC has not been filed by the Plaintiff, in view of the statement given by the Plaintiff in Court, this Court is inclined to permit the Plaintiff to withdraw the present Suit in toto.
4.
The Suit is disposed of as withdrawn, along with the pending applications, if any.
