Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.') (Old Section 482 of the Code of Criminal Procedure, 1973 (hereinafter referred to as 'Cr.PC'), has been filed on behalf of the Petitioners, for quashing of FIR No.0100/2025 dated 12.09.2025 under Section 140(3)/3(5) of the Bharatiya Nyaya Sanhita, 2023 (hereinafter referred to as 'BNS') registered at Police Station Barakhamba Road, New Delhi and all the consequential proceedings emanating therefrom, in terms of the Settlement dated 29.10.2025. On advance Notice, learned APP has appeared and accepted the Notice on behalf of the State.

The allegations in the said FIR are that the Petitioners had abducted Nikunj and Asmit Rangar, Respondent Nos. 4 and 5 respectively and taken them to their village and they were released only after the money was paid on behalf of the victims.

On the Complaint of the Respondent No.2/Complainant, FIR No.0100/2025 dated 12.09.2025 under Section 140(3)/3(5) of BNS, got registered at Police Station Barakhamba Road, New Delhi. 8.
It is stated that the Petitioner and the Respondent No. 2 have amicably settled all the disputes and differences between them and arrived at Settlement vide Memorandum of Settlement (MOU) dated 29.10.2025. 9.
The two victims, Nikunj Dayal and Asmit Rangar, Respondent Nos. 4 and 5 respectively are present in the Court and have been identified by their Counsel and Investigating Officer concerned and have endorsed the contents of the said FIR. They have submitted that they both have taken away and were released only after the money was given. 10.
Considering the nature of the allegations, it is not a fit case where the said FIR can be quashed, on the basis of the Settlement dated 29.10.2025. Looking at the gravity of the allegations, the quashing of the said FIR is denied and the Petition is dismissed and disposed of accordingly. Pending Application, if any, also stands disposed of.
