This is an application filed on behalf of petitioner seeking condonation of 70 days delay in re-filing the petition. 2.

For the reasons mentioned in the application, same is allowed. 3.

Application stands disposed of.

The present petition has been filed on behalf of petitioner under Section 528 BNSS, 2023 seeking quashing of FIR No. 158/2021 under Section 354/354(B)/506/509 IPC registered at PS-Lodi Colony on the ground that the parties have resolved their differences amicably. The brief facts of the case are that the aforesaid FIR was registered on the complaint of respondent no.2 wherein she had alleged misbehaviour by the petitioner.

During pendency of the proceedings, with the intervention of family and friends, the parties have resolved all their disputes amicably without any coercion or pressure.

The complainant is present in Court. On a query posed by the Court, she states that she has settled the matter with the petitioner and does not wish to prosecute the criminal proceedings.

Issue notice. Mr. Ajay Vikram Singh, learned APP for the State accepts notice.

Petitioner, as well as, respondent no. 2, are present in Court and they have been identified by their respective counsel, as well as, by SI Priyanta. 10.

Respondent no.2, on a query posed by the Court, states that she has no objection in case the FIR is quashed.

In view of the fact that the petitioner as well as respondent no.2 have amicably settled their disputes, and regard being had to the statement made by the complainant, this Court is of the view that no useful purpose will be served in continuation of criminal proceedings and it will be an exercise in futility.

It is, thus, in the interest of justice that the present FIR and all the other proceedings emanating therefrom be quashed. 13.

Consequently, the petition is allowed and the FIR No. 158/2021 under Section 354/354(B)/506/509 IPC registered at PS-Lodi Colony alongwith all other proceedings emanating therefrom, are quashed. 14.
