BAIL APPLN. 4487/2024 1.

This is an application seeking anticipatory bail in FIR No. 574/2024 dated 04.11.2024 registered under Sections 115(2)/333/351(2)/3(5) BNS 2023 registered at PS Prashant Vihar.

As per the FIR, it is stated that the petitioner along with 3 people barged into the office of the complainant and beat him with fists and blows. 3.

It is stated by Mr. Pankaj, learned counsel for the petitioner that in the present case all the co-accused have been granted anticipatory bail and the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. petitioner is not the one who had physically assaulted the complainant. 4.

In addition, it is also stated that the applicant is ready to join investigation and cooperate with the investigating agency. 5.

It is submitted that the only reason why the Sessions Court denied bail to the petitioner is that there are 2 FIRs against the petitioner and in both the FIRs the petitioner has already been granted bail. 6.

I am unable to agree.

I have seen the CCTV footage, wherein it is seen that the petitioner along with other people barged into the office of the complainant and physically assaulted him.

The police requires custodial investigation of the petitioner to know as to why the petitioner accompanied other accused to the office of the complainant to physically assault him.

In addition, there are NBWs issued against the petitioner in this case and the petitioner has not yet taken any proceedings for cancellation of those NBWs.

The present petition cannot be a substitute seeking cancellation of NBWs.

For the said reasons, I am not inclined to entertain the present application and the same is dismissed.

The application is disposed of.
