Petition under Section 482 of the Code of Criminal Procedure, 1973 (under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023) (hereinafter referred to as 'B.N.S.S.'), has been filed on behalf of the Petitioners, for quashing of the Complaint bearing CC No.1020/2022 under Section 138 read with Section 141 of the Negotiable Instrument Act, 1881, passed by learned JMFC (NI Act), Digital Court-02/SED, Saket Courts, New Delhi, qua the Petitioner No. 3/Accused No. 5 and the Respondent No. 2/Accused No. 2 and Respondent No. 3/Accused No. 4, on the ground that they are not the Executive Directors.

a discharge for which, it is the Summoning Order, which should have been challenged.

Learned counsel for the Petitioners, seeks permission to withdraw the Petition with liberty to file the appropriate Petition afresh before the appropriate forum.

It is submitted that the personal appearance of the parties, may be exempted. However, the Petitioners are at liberty to move an appropriate Application before the Court of Learned Metropolitan Magistrate. 7.

No further directions are merited in the present Petition, which is disposed of accordingly. The pending Application, if any, also stands disposed of.
