The present revision petition has been filed under Section 115 of the Code of Civil Procedure, 1908 ["CPC"], against an order dated 14.08.2025 passed by the District Judge, Commercial Court-05, (Central) Tis Hazari Courts, Delhi, in Execution (COMM) No. 469/2023, by which the Commercial Court has rejected an application filed by the petitionerdecree holder for issuance of precepts under section 46 read with Order XXI Rule 23 read with Rule 24 and 43, as well as Section 51 and 151 of CPC, in respect of execution of an arbitral award dated 28.02.2022. It may be noticed, at the outset, that interlocutory orders of the Commercial Court are not subject to revision in view of Section 8 of the Commercial Courts Act, 2015. Even otherwise, the issuance of precept would, in any event, not dispose of the execution proceedings and the revision petition is, therefore, not maintainable in view of the proviso to Section 115 (1) of CPC.

The present revision petition is, therefore, dismissed. The petitioner is free to take appropriate remedies, as may be available to it in law.
