% 26.09.2018 Vide order dated 15th February, 2017 Electoral Registration Officer was permitted to be summoned.
However, remaining witnesses were not permitted to be summoned. Learned counsel for the petitioner submits that record of CRL.M.C. no. 3608/2015 titled Mamta Yadav vs. State of NCT of Delhi is necessary to be summoned through the Registry of the High Court as well as record of case bearing FIR No. 22/2010, P.S. Dwarka Sector 23 titled State vs. Mamta Yadav along with bail bond of Mamta Yadav and affidavit of Harpal Singh through Ahlmad, wherein Mamta Yadav has been shown as wife of Harpal Singh. Petitioner has filed a complaint against her husband, namely, Harpal Singh alleging bigamy committed by him. I am of
the view that aforesaid record may be necessary to the lis. Accordingly, petitioner is permitted to summon the record as detailed above on the next date. Learned Metropolitan Magistrate shall issue summons for summoning the aforesaid witnesses along with record on the date to be fixed by the learned Metropolitan Magistrate.
Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
