The petitioner seeks quashing of the FIR No.
RC0032020A0021, dated 30.07.2020 for offences under Section 120B/ read with Section 420/468/471 of the Indian Penal Code, 1880 registered at Police Station CBI ACB, Delhi and all consequential proceedings.

The FIR was registered alleging that the petitioner had taken employment on the basis of forged documents. 5.

persons. He submits that the CBI had though investigated but has not taken note of various documents which are sought to be placed by the petitioner on record. He submits that incomplete chargesheet has been filed without obtaining the relevant documents.

The chargesheet in the present case was filed way back on 16.02.2021 and the supplementary chargesheet was also filed way back on 20.03.2023. It is informed that the matter is now listed for arguments on charge in the month of January, 2025. 7.
Concededly, the learned Trial Court is competent to hear all arguments on merits. If the petitioner is of the opinion that certain part of the investigation has been left out, an appropriate application can always be filed by the petitioner before the learned Trial Court.

Considering the above, the learned counsel for the petitioner seeks liberty to withdraw the present petition and file an appropriate application before the learned Trial Court and take all arguments before the learned Trial Court at an appropriate stage.

The petition is dismissed as withdrawn with the aforesaid liberty.

It is made clear that this Court has not made any observation on the merits of the case and the learned Trial Court shall proceed further on its own merits without being influenced by either the present order or the filing of the present petition by the petitioner.

Pending application also stands disposed of.
