% 23.01.2018 IA No.1112/2018 (of the plaintiff under Order XXIII Rule 3 CPC) 1.

The counsel for the sole plaintiff and the counsel for the sole defendant state that the application is signed by the plaintiff as well as by the defendant themselves and is also supported by the affidavits of the plaintiff and the defendant. It is further stated that the plaintiff as well as the defendant are personally present in the Court. 2.

The plaintiff in this suit, inter alia for partition of property No.D-413, Defence Colony, New Delhi, has under the compromise released all her right, title and interest in the property in favour of the defendant. A copy of the Released Deed executed is filed along with the application. 3.

I have perused the compromise arrived at and find the same to be lawful.

The application is allowed and disposed of.

In accordance with the compromise, the counsel for the plaintiff withdraws the suit.

The suit is dismissed as withdrawn.

However, the parties are ordered to be bound by the compromise and in accordance with the compromise, the amount of Rs.7 lacs deposited by the defendant in this court along with interest if any accrued thereon be also refunded to the defendant.

No costs.

The date of 16th February, 2018 before the Joint Registrar is cancelled.
