O R D E R

% 19.04.2017 The petitioner assails the order dated 28.10.2014 passed by the Central Administrative Tribunal, Principal Bench, New Delhi whereby the M.A. No. 1459/11 moved in O.A. No. 426/05 has been dismissed. By this application, the petitioner sought impleadment in the said O.A as an Intervenor.

The Tribunal dismissed the application moved by the petitioner on the ground that the cause of action has arisen in the year 1999, when the selection process for the post of Fire Operators was undertaken and the petitioner was disqualified. However, M.A. 1459/2011 was filed in the year 2011. The petitioner moved the aforesaid M.A. only on 16.05.2011. There was immense delay on the part of the petitioner in

moving the application before the Tribunal. Learned counsel for the petitioner has submitted that he firstly moved this Court in the earlier proceedings in the year 2010. That does not improve the situation for the petitioner. As if the aforesaid delay was not enough, the petitioner has also taken his own sweet time to file the petition against the impugned order dated 28.10.2014, without any explanation for the delay.

In view of the aforesaid, we are not inclined to interfere with the impugned order, as the application for intervention was barred by limitation and the present petition is barred by laches. Dismissed.
