The present petition under Section 25B(8) of the Delhi Rent Control Act, 1958, seeks the following prayers: - "a) Call the record of the Ld. Trial Court in eviction petition no. petition no. RC/ARC No. 02/2021 titled "Padam Chand Jain Vs M/s Bharat Engineering Works & Anr." and the impugned order dated 07.07.2025, passed by the Court of Ms Richa Sharma, Ld. SCJ Cum RC, West District, Tis Hazari Courts, Delhi, in Eviction Petition No. RC/ARC No. 02/2021, titled "Padam Chand Jain Vs M/s Bharat Engineering Works & Anr.", may kindly be set aside and quashed. Dismiss the underlying Eviction Petition No. RC/ARC No. 02/2021 titled "Padam Chand Jain Vs M/s Bharat Engineering Works & Anr.

b) Costs throughout may also be awarded in favour of the Petitioner and against the Respondent.

may deem fit and proper, in favour of the Petitioner." 3.

Learned counsel appearing on behalf of the petitioner, on instructions of the latter, who is present in the Court, submits that the subject property shall be vacated by 31.10.2026.

It is further agreed between the parties that the petitioner shall pay a sum of Rs.33,000/- as use and occupation charges from 07.01.2026 per month on or before 10th of every month.

In view of the above, learned counsel for the petitioner seeks leave to withdraw the present petition.

The present petition is dismissed as withdrawn and disposed of. 8.
