CORAM:
HON'BLE MR. JUSTICE A.K. PATHAK
O R D E R
% 15.03.2017 Petitioner has filed an application under Section 127 of the Cr.P.C. for enhancement of interim maintenance, which has been rejected by the Family Court. Vide order dated 4th October, 2010 petitioner was awarded interim maintenance of `60,000/-. Family Court has noted that main maintenance petition, a time bound case has been fixed for arguments on 27th February, 2017 and is likely to be disposed of in the month of April, 2017, accordingly, there was no point in entertaining the application under Section 127 of the Cr.P.C. It is apparent from a perusal of aforesaid order that petition under Section 125 Cr.P.C. is at fag end and is likely to be
disposed of on merits; after trial and for these reasons Section 127 Cr.P.C. application has not been entertained.
I do not find any jurisdictional error in the impugned order. Writ petition is dismissed.
Miscellaneous applications are disposed of as infructuous.
