% 18.04.2018 By this petition, the petitioner has sought extension of interim bail granted to the petitioner vide order dated 12th February, 2018 in bail application no. 299/2018 in case FIR No. 380/2017 under Section 20 NDPS Act registered at Police Station, Badarpur.

Petitioner was arrested in case FIR No. 380/2017 under Section 20 NDPS Act on 6th November, 2017 and was in custody when she preferred bail application no. 299/2018 on the ground that she was in the advance stages of pregnancy and was to deliver the child. Thus, this court granted interim bail for a period of six weeks from the date of her release. The said period of six weeks expired on 27th March, 2018 as stated by learned counsel for the petitioner. Hence, the present bail application seeking BAIL APPLN. 640/2018

extension of interim bail.

Learned counsel for the petitioner states that after the birth of the child both the petitioner and her child have been suffering from ailments, thus further interim bail be granted. When the petition came up for hearing on 23rd March, 2018, this court while issuing notice to the respondent/State also directed that the interim bail granted to the petitioner should continue till today on the same terms and conditions.

From the perusal of the status report and the documents verified, it is revealed that there is no serious ailment either to the petitioner or to the infant child. Further, the petitioner's family comprises of her sister-in-law and father who take care of the four kids of the petitioner. Considering the facts that the petitioner has already delivered a child and there is no serious ailment to the petitioner or the child, this Court finds no ground to further extend the interim bail. Bail application is dismissed.
