Though this application is titled as under Order 23 Rule 3 CPC, since the application is for withdrawal of the appeal, it would be treated as an application under Order 23 Rule 1 CPC.

It is prayed that the appeal be allowed to be withdrawn as parties have compromised the disputes. In view of the fact that parties have comprised the disputes, this appeal is disposed of as withdrawn. Parties now be bound by the terms of the Memorandum of Understanding/Family Settlement dated 26.5.2017, of course in accordance with law. FAO 279/2011

Since the appeal is withdrawn interim orders passed would stand vacated. C.M stands disposed of.
