These writ petitions are filed on behalf of the Petitioners under Article 226 of the Constitution of India laying a challenge to decision of Western Regional Committee ('WRC') of NCTE taken in its 434th meeting held on 28th -30th August 2025 to initiate proceedings for carrying out inspections of the Petitioners' institutions. 2.
Mr. Mohinder J.S. Rupal, learned counsel appearing for the Respondents submits that the writ petitions are premature inasmuch as no final decision has been taken so far for carrying out inspections of the Petitioners' institutions. Bare perusal of the minutes of 434th meeting of WRC would show that the committee has only recommended that the matter be forwarded to NCTE HQs (Inspection Division) in light of complaint received and final decision for carrying out inspections will be taken by NCTE HQs, whereafter further action will be taken as per procedure prescribed under Section 13 of NCTE Act, 1993 and Petitioners will be duly informed of the same and will be associated with the inspections. 3.
On a perusal of the minutes of 434th meeting of WRC held on 28th30th August, 2025, I find merit in the contention of Mr. Mohinder J.S. that WRC has only made a recommendation that matter be forwarded to NCTE HQs (Inspection Division) since complaint was received. Final decision on this aspect is yet to be taken and the writ petitions are thus premature. It cannot be presumed at this stage that the final decision will be in conformity with the recommendation made. Moreover, Section 13 of NCTE Act provides a procedure for inspection for purpose of ascertaining whether recognised institutions are functioning in accordance with provisions of said Act and sub-Section (2) of Section 13 provides that the Council shall communicate to the institution the date on which inspection under sub-Section (1) is to be carried out and institution shall be entitled to be associated in such manner as may be prescribed.
Therefore, the statutory provision itself mandates communication to the Petitioners if inspection is to be carried out and also provides a safeguard that Petitioners will be associated with the inspection. Since the decision under challenge is only a recommendation of the WRC, at this stage no interference is called for. Needless to state that as and when final decision is taken by NCTE HQs (Inspection Division) to carry out inspections, advance intimation will be given to the Petitioners and they will be entitled to take recourse to remedies available in law.

Writ petitions along with pending applications are disposed of as being premature at this stage. All rights and contentions of the respective parties are left open. It is made clear that this Court has not expressed any opinion on merits of the cases.
