The present petition has been filed by the Petitioner-Best Crop Science Pvt. Ltd. under Article 226 and 227 of the Constitution seeking issuance of a writ of mandamus for directing the re-export of the goods imported vide bill of entry no.5017575 dated 12th August, 2024.

According to the Petitioner, the said bill of entry was filed on 12th August, 2024. The Directorate of Revenue Intelligence (hereinafter 'DRI') had inspected the goods at port and drew samples along with the direction-not to release the goods. served till date nor has any permission been granted to release or re-export the goods. The Petitioner submits that the representation filed by them on 15th October, 2024 has not been considered either. 4.
Ld. Counsel for the Respondent Nos. 3 and 4 has sought instructions and submits that insofar as the goods are concerned, the Department needs further time to issue a notice to the Petitioner stating its objections. Considering the fact that a representation has already been filed, let the said representation be decided by the Department (Respondents) within a period of two weeks i.e., by 24th December, 2025 by way of a speaking order. The remedies of the Petitioner in respect of the said order are left open. Needless to state, that the issue of jurisdiction has not been gone into at this stage.

It is also submitted that the appearance of ld. Sr. Counsel for the Petitioner and of Mr. Ojha, ld. Counsel for Respondent Nos. 2 to 4 has inadvertently not been included in the last order. It is clarified that the said appearance is recorded for the last hearing and for today's hearing. 6.
Accordingly, the petition is disposed of. All pending applications are also disposed of.
