This application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ('BNSS'), has been filed by the Petitioner seeking relaxation of the condition imposing furnishing of a local surety in compliance with the order dated 10.12.2024.

Learned counsel for the Petitioner states that the Petitioner is willing to furnish a surety from his home state, Uttar Pradesh. He states that at paragraph no. 7 of this application, the Petitioner has duly disclosed the mobile number of Petitioner's wife and the address of his family, where the Petitioner intends to reside.

Issue notice. Learned Standing Counsel accepts notice. Upon a query raised by this Court, he states that the Petitioner has already undergone a period of incarceration of thirteen (13) years and otherwise the overall conduct of the Petitioner has been satisfactory in jail. 4.

In view of the averments made in the application and the submissions recorded hereinabove, the relief sought in the application is allowed in terms of prayer clause (b) of this application. It is directed that Applicant be released on furlough subject to furnishing a personal bond in the sum of Rs. 10,000/- with one surety from his home state, Uttar Pradesh. All other terms and conditions of the order dated 10.12.2024 remain unchanged. 5.

A copy of this order be sent to the Jail Superintendent. 6.
