O R D E R
% 12.05.2016 This is application under Section 438 of Cr.PC moved by the petitioner for grant of anticipatory bail in case FIR No.996/2015 under Section 376D/506/34 IPC registered at Police Station Nazafgarh, Delhi.
It is submitted by learned counsel for the petitioner that on the last occasion, the petitioner was granted interim protection because prosecutrix had appeared in person and did not identify the petitioner to be responsible for commission of rape upon her. Pursuant to the directions given by this Court, the petitioner has joined investigation. He further submits that the petitioner is ready to join further investigation. Learned Additional Public Prosecutor for the State does not dispute this fact and admits that the petitioner has joined investigation and now the charge-sheet has also been filed. Keeping in view the totality of the facts and circumstances of the case, the interim protection granted to the petitioner on 16.03.2016 is hereby confirmed and it is ordered that in the event of his arrest:- (v) Petitioner be admitted to bail on his executing personal bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand only) with one surety in the like amount to the satisfaction of the concerned I.O./SHO.
(vi) He shall join the investigation as and when called for by the I.O. (vii) He shall furnish his address as well as his contact number to the Investigating Officer. (viii) He shall not threaten or coerce the prosecutrix or her family members or any prosecution witness.
The application is accordingly disposed of.
