The suit was instituted in this court but on account of change in the pecuniary jurisdiction it was transferred to the file of the District Courts where it came to be eventually settled and decreed in its terms by order dated 17.03.2016 of the Additional District Judge-01, South-West, Dwarka, New Delhi.

In the wake of such amicable resolution of the dispute, the plaintiff made an application seeking refund of the court fees in terms of Section 16A of the Court Fees Act, 1870 read with Section 89 CPC. This prayer was granted by the ADJ by order dated 12.04.2016. No further directions are required to be passed by this Court only because the case was initially instituted in this court. The order granted by the trial court has to be enforced and complied with by the appropriate authority. 3.
