O R D E R

% 25.07.2016 By this petition the petitioner seeks parole on the ground that he has to re-establish ties and file the Special Leave petition before the Hon'ble Supreme Court challenging the judgment dated 9th February, 2015 of this Court upholding the conviction of the petitioner. The allegations on which the petitioner has been convicted are of committing rape of his minor daughter. Thus there is no question of reestablishing ties with the family. The petitioner has given the address of his friend where he proposes to stay if parole is granted. The statement of the friend Pramod has already been recorded wherein he states that on release Hoshiyar Singh would reside with him. However, from the facts noted above and the sentence awarded to the petitioner, there is no material on the basis of which it can be assured that the petitioner would not jump the parole W.P.(CRL) 925/2016

granted to him.

Considering the facts and circumstances of the case, I find no illegality in the order of the competent authority communicated to the petitioner vide communication dated 22nd February, 2016 declining to nongrant parole to the petitioner. The Special Leave Petition can be filed through Jail.

Petition is dismissed.

Copy of the order be communicated to the petitioner through Superintendent, Tihar Jail.
