% 14.05.2018 Respondents have appeared through Mr.

Rajesh Manchanda, Advocate, who after instructions, submits that without prejudice to the contentions of the respondents, the petitioner (defendant in the case) may be allowed to examine himself to tender in evidence the documents in question i.e. Ex.DW-1/31 to 37 subject, of course, to the right of the respondent (plaintiff of the case) to cross-examine him further in the light of this additional material. The limited prayer to above effect, as is pressed by the petitioner, is allowed and the impugned order of the trial court, rejecting the prayer to such effect, accordingly modified. Needless to add, given the old pendency of the case, the petitioner will be granted only one date of hearing for introducing above-mentioned documents in evidence through his own CM(M) 343/2018

deposition on the date to be fixed for the purpose by the trial court and he shall be tendered for cross-examination by the opposite party on same date. No adjournment on any ground whatsoever shall be granted. The petition and the application stand disposed of. R.K.GAUBA, J.
