The petition seeks a mandamus to the respondent No.1 IDBI Bank Ltd. Mahipalpur, New Delhi to allow the petitioner to operate Account No.0075102000024727 in the name of Daiki Sea Trading of which the petitioner claims that he, along with the respondent No.2 Ms. Sapna Devi, was a partner.

The petitioner has disputes with the respondent No.2 relating to the said partnership in the name and style of Daiki Sea Trading. 3.
The counsel for the petitioner, on enquiry, as to how such inter se disputes between the petitioner and the respondent No.2 including with respect to monies in account with respondent No.1 Bank can be made subject matter of a writ petition, states that a suit qua partnership disputes has been filed and is pending consideration.

The bank account which the petitioner is seeking to operate being admittedly in the name of a partnership and relating to which partnership there are disputes and differences between the partners, no direction as sought can be given in writ jurisdiction. The remedy if any of the petitioner is to apply in the Suit Court seized of the partnership disputes. 5.
The petition is dismissed with liberty aforesaid to the petitioner. No costs.
