Crl. M.C. 1496/2018 Notice. Learned APP accepts notice for responded no.1. Respondent no.2-Bhawana is present in court along with her counsel and accepts notice. Respondent no.2 has been identified by SI Govind Singh of police station Uttam Nagar. She submits that she has settled the matter with the petitioner no.1 of her own free will and without any undue force, pressure or coercion before the Delhi Mediation Centre, Dwarka Courts, New Delhi on 19th January, 2018. She further submits that her marriage with petitioner no.1
has already been dissolved by a decree of divorce by mutual consent passed by the Family Court, South West District, Dwarka Court, New Delhi on 9th March, 2018. Petitioner no.1 has paid `2 lacs to the respondent no.2 today in Court vide a demand draft, photocopy whereof has been placed on record. She submits that with this payment entire settled amount of `8 lacs stands paid and she has no objection in case FIR No. 477/2015 under Sections 498A/406 IPC registered at police station Uttam Nagar is quashed. Affidavit of respondent no.2 is also on record. Keeping in mind the settlement arrived at between the petitioners and respondent no. 2 voluntarily, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms.
