$~47 * IN THE HIGH COURT OF DELHI AT NEW DELHI + W.P.(C) 2800/2018 AJAY KUMAR & ORS ..... Petitioner Through Mr.B.S.Maan with Mr.Vishal Mann, Advs.

versus GOVT. OF NCT OF DELHI & ANR ..... Respondent Through Mr.Anjum Javed, ASC for R-1.

Mr.Arjun Pant, Adv for DDA.

CORAM:

HON'BLE MS. JUSTICE REKHA PALLI

O R D E R

% 22.03.2018 After some arguments, learned counsel for the petitioners concedes that the petitioners have not made any representation to the respondents seeking demarcation after 12.08.2016 i.e. the date when the order was passed by the Hon'ble Supreme Court restraining the petitioners from creating any third party rights in the land. He, therefore, seeks leave to withdraw the present petition with liberty to make a representation to the respondents seeking demarcation of his land. He further prays that the respondents may be directed to deal with the representation in an expeditious manner. Mr.Anjum Javed, who appears on advance notice for the respondent no.1 does not oppose the aforesaid prayer sought by learned counsel for the petitioner.

It is accordingly directed that, in case the petitioners makes a representation seeking demarcation of their land within one week, the respondents will decide the same as per law, within four weeks from today, by passing a reasoned and speaking order. The writ petition is dismissed as withdrawn with the liberty as prayed for.

Needless to say in case, the petitioners are aggrieved by the decision taken by respondents, they would be at liberty to take all legal recourse as permissible under law.
