% 15.11.2019 C.M. No. 48792/2019 By this application, the petitioner seeks leave to withdraw the present petition with liberty to file afresh after explaining the delay and latches in preferring the writ petition.

The present writ petition has been preferred by the petitioner to seek the following reliefs:

"i) issue a writ of mandamus or any other appropriate writ, order or direction thereby, inter alia, declaring that acquisition proceedings in respect of the land belonging to the petitioners land admeasuring (4 - 16) falling in khasara no. 1368/1, 1368/2/1, 1368/2/2 situated in village Chattarpur, Tehsil,

Mehrauli, New Delhi - 110030, have been lapsed on the commencement of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013;

ii) issue a writ or any other appropriate writ, order or direction thereby direct the respondents not to interfere in the peaceful possession of the petitioners qua the land subject matter of the present writ petition;

iii) Any other relief, order or direction which this Hon'ble Court deems fit and proper may also be passed in favour of the petitioners."

In view of the aforesaid, the petition is dismissed as withdrawn with liberty as prayed for.

The matter need not be listed on 02.03.2020.
