The petitioner seeks regular bail under Section 439 Cr.P.C. in case FIR No.714/2015 registered under Sections 420/468/471 IPC at PS Palam Village, South-west, Delhi. Status report is on record. 2.

I have heard the learned counsel for the parties including the counsel for the complainant and have examined the file. During the course of arguments, on instructions, petitioner's counsel informed the willingness of the petitioner to pay `8.5 lacs to the complainant without prejudice and subject to future adjustment. It was agreed that `2.5 lacs shall be paid by the petitioner to the complainant within two weeks and the remaining amount of `6 lacs shall be paid within next three months. On this, the complainant has no objection to the grant of bail.

The petitioner is in custody since 10.02.2016. Considering the facts and circumstances of the case and the petitioner's offer to pay alleged cheated amount of `8.5 lacs to the complainant within a stipulated period, the petitioner is admitted to bail on furnishing personal bond in the sum of ` 50,000/- with one surety in the like amount to the satisfaction of the Trial Court. He shall pay `2.5 lacs to the complainant within two weeks and the remaining amount of `6 lacs shall be paid within next three months through Investigating Officer by way of Demand Draft in the name of the complainant. This payment shall be without prejudice and subject to future adjustment (if any). In case of non-compliance, State / complainant shall be at liberty to approach this Court.
