The present transfer petition under Section 447 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeks transfer of Criminal Appeal No. 224/2025, titled Satish Chand Singhal v. Ravi Chopra, presently listed before the Special Sessions Judge, South District, to the Court of the Sessions and District Judge (South-East District), Saket Courts, New Delhi. 2.
Mr. R. Raghunath, counsel for the Petitioner, submits that the appeal, arising from the judgment dated 16th May, 2025 passed by the JMFC (SouthEast), Saket Courts, was inadvertently placed before the Appellate Authority of the South District due to a clerical or system-level error in the e-filing process. It is urged that since the conviction emanates from the South-East District, the appeal lies before the Appellate Court of that district, and the present transfer is necessary to cure the jurisdictional defect and ensure The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Mr. Rachit Batra, counsel for the Respondent opposes the petition, contending that the proceedings sought to be transferred are non est and, therefore, instead of seeking transfer, the Petitioner ought to withdraw the proceedings and, if so advised, file a fresh appeal. 4.
The Court has considered the Respondent's objection but finds no merit in the same. Where a jurisdictional error has occurred on account of filing or listing, the request for transfer is maintainable. Accordingly, the petition is allowed, and Criminal Appeal No. 224/2025 titled "Satish Chand Singhal v. Ravi Chopra" is transferred from the Court of the Special Sessions Judge, South District, to the Court of the Sessions and District Judge (South-East District), Saket Courts, New Delhi. 5.
Copy of the order be sent to the concerned Principal District and Sessions Judge for necessary information and compliance.
