CRL.M.C. 1811/2018 1.

The petitioner seeks quashing of FIR No. 459 of 2016 under Sections 452/324/506/34 of the IPC Police Station Bindapur, New Delhi, based on a settlement.

The subject FIR was registered consequent to an altercation that took place between father-in-law and son-in-law. The disputes arose as the petitioner had married the daughter of the respondent no. 2 without his consent.

The parties are related to each other. Petitioner is the son-in-law of respondent no. 2. Petitioner no. 2 is a friend of petitioner no. 1. Settlement deed has been executed on 08.03.2018. It is stated by CRL.M.C. 1811/2018

petitioner no. 1 and respondent no. 2 that the relations between the family are now cordial and there are no dispute surviving between them.

Respondent no. 2 is present in person in Court today and is identified by the Investigating Officer. He submits that he has settled the disputes with the petitioners. Respondent No. 2 further submits that he does not wish to press the criminal complaint against the petitioners any further.

In view of the fact that the disputes between the parties has been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would also be expedient to quash the subject FIRs and the consequent proceedings emanating therefrom.

In view of the above, the petitions are allowed FIR No. 459 of 2016 under Sections 452/324/506/34 of the IPC Police Station Bindapur, New Delhi and the consequent proceedings emanating therefrom are, accordingly quashed.
