O R D E R

1. On account of demise of the previous Arbitrator, Mr. Justice S.K. Mahajan, with the consent of the parties, this Court appoints Mr. Justice Shiva Kirti Singh, a former Judge of the Supreme Court (Mobile No. 9899016327) as the sole Arbitrator to adjudicate the disputes between them. The arbitration will resume from the stage where it was before Justice Mahajan.

2. Mr. Justice Shiva Kirti Singh shall fix his own terms and communicate them to the parties.

3. The parties are directed to appear before Mr. Justice Shiva Kirti Singh on 18th May, 2017 at 4 pm or such changed time and/or date that he finds convenient which will be communicated by him to the parties at least ten ARB.P. 174/2017

days in advance. The venue for the first hearing will be arranged by the Petitioner and communicated to Justice Shiva Kirti Singh and the Respondent at least one week prior to the date fixed. The expenses for the hearing shall be shared by the parties.

4. The arbitral record be collected by the Petitioner from the office of Mr.Justice S.K. Mahajan and be placed before Mr. Justice Shiva Kirti Singh at the earliest.

5. The petition is disposed of in the above terms. A certified copy of this order be delivered to Mr. Justice Shiva Kirti Singh forthwith.
