O R D E R

% 07.02.2019 The learned Special Public Prosecutor for petitioner Central Bureau of Investigation (CBI) fairly concedes that report (charge-sheet) under Section 173 of the Code of Criminal Procedure, 1973 (Cr.P.C.) has already been submitted in the court of Special Judge after conclusion of investigation into FIR - RC No. DAI-2015-A-0042 - under Sections 120 B IPC and 13 (2) read with 13 (1) (d) of PC Act, 1988 and that no evidence connecting the three accounts of the respondent M/s Laxmi Enterprises, proprietory concern of Dinesh Kumar Gupta, resident of B-1/644, Shastri Nagar, Delhi -110052 namely bank account nos.

00845011000539, 00845011000157 and 00841010005580 maintained in Oriental Bank of Commerce, branch office Wazirpur, with the crimes which are subject matter of the criminal case arising out of such charge-sheet has been found and, therefore, the objection to the de-freezing of the said accounts as directed by the special judge by the impugned order dated 28.01.2016 no longer subsists. In this view, she submitted that she may be permitted to withdraw the present petition.

The petition is dismissed as withdrawn.
