% 01.08.2016 By this petition the petitioner seeks parole on the ground that he has to file Special Leave Petition before the Supreme Court challenging the judgment of this Court dated 13th October, 2015 dismissing Crl.Appeal No.304/2013 filed by him.
Learned Additional Standing Counsel for the State submits that the permanent address of the petitioner is Village and Post Office Amarpur, PS Khanpur, Tehsil Shyana, District Bulandsahar, U.P. where his family members are residing. The Delhi address belongs to the mother-in-law of the younger brother where he was residing on rent prior to his arrest. As per the nominal roll, sentence of the appellant was suspended pending hearing of the appeal for a period of four weeks when the petitioner W.P.(CRL) 920/2016
did not misuse the concession and surrendered on time. Considering the past conduct of the petitioner and the fact that he has roots in the society as his family is residing in Bulandshahar, I deem it fit to grant parole to the petitioner.
It is, therefore, directed that the petitioner be released on parole for a period of four weeks on his furnishing a personal bond in the sum of `25,000/- with one surety of the like amount subject to the satisfaction of the learned Trial Court/CMM/Duty Magistrate.
Petition is disposed of.
Copy of the order be communicated to the petitioner through Superintendent, Tihar Jail.
