% 03.08.2016 Mr. Kunjan Arora, Director of the respondent company, is present in person.
Both Mr. Arora and counsel for the petitioner state that the matter has been amicably settled with the respondent undertaking to pay a sum of Rs.1,25,000/- in full and final settlement of all the claims of the petitioner company, which are the subject matter of the instant proceedings, including all costs, interest etc. Towards this, Mr. Arora has handed over a cheque bearing No.000576 for a sum of Rs.1,25,000/-, dated 11.08.2016, drawn on HDFC Bank, to counsel for the petitioner who has accepted the same subject to its encashment. Mr. Arora further undertakes to this Court that the said cheque will be encashed on presentation, and to ensure that sufficient funds
are maintained in the relevant account at all times during the period of validity of the cheque.
Mr. Arora has also handed over another cheque of Rs.11,000/- towards costs imposed on 26.03.2015. He states that the said cheque is also good for payment, and will be duly encashed on presentation during the period of its validity.
Mr. Arora's undertakings to this Court are accepted by this Court, and he shall remain bound by the same. Consequences of the breach of the undertakings have also been explained to him. Counsel for the petitioner states that under the circumstances, he does not wish to press this matter any further whilst reserving the right to file any fresh petition, and also to initiate proceedings in contempt, as his client may be advised in case of any breach. He is permitted to do so. Consequently, and as prayed, the petition and all pending applications stand disposed off in terms of the aforesaid settlement. SUDERSHAN KUMAR MISRA, J AUGUST 03, 2016\ dr
