Petitioner impugns order dated 02.02.2018 whereby conditional leave to defend was granted to the respondent. 2.

Learned counsel for the petitioner submits that the respondent failed to comply with the condition imposed and also failed to file the written statement within time and accordingly a decree has been passed in the suit on 21.04.2018.

In view of the above, learned counsel for the petitioner seeks leave to withdraw the petition. The petition is accordingly dismissed as withdrawn.
