% 08.12.2016 The status report has been placed on record. Ms. Rao submits that in view of the complaint made by the petitioner to the Commissioner of Police at the administrative level, the investigation on the complaint of the petitioner has been transferred to the Crime Branch on 05.11.2016. The present I.O., who is present in court, states that he shall take over the case including the CCTV footage and all other evidences collected by the earlier I.O. into his custody. He further assures the court that he shall expedite the remaining investigation so that the report can be filed before the court without any delay.
Let the same be filed at the earliest and preferably within two months. The petitioner also has a grievance with regard to the non-registration of the FIR on his complaint in a timely manner and on the acts and omissions of the SHO PS Defence Colony.
In my view, the grievance stands partially remedied on account of transfer of investigation to the Crime Branch. In any event, if the petitioner is still aggrieved, it is open to him to approach the Commissioner of Police in this respect.
