On the last date of hearing, the petitioner had failed to file a rejoinder. Further, learned counsel for the respondent had pointed out that the present petition had been rendered infructuous for the reason that permission was sought by the petitioner for participating in the counselling held for the MD/MS Course, which was fixed for 6th June, 2013 and much water has flown under the bridge thereafter. He had W.P.(C) 4039/2013

further stated that the petitioner has not laid a challenge to the policy of the respondents for selection of AFMS Officers for DNB. In view of the aforesaid position, counsel for the petitioner had sought time to obtain instructions and the case was adjourned.

Today, learned counsel for the petitioner states that he has not received any instruction from the petitioner though efforts were made to contact him. He states that an e-mail had been also dispatched to the petitioner on 19th February, 2016 but he has not responded to the same. 3.

It appears that the petitioner is not interested in prosecuting the present petition.
