After arguments, this appeal as also the suit be treated as withdrawn and appellant/plaintiff is granted liberty to file a suit for possession on the basis of the title, and with respect to which merits this Court makes no observation, one way or the other. 2.
It is also agreed that whatever time is spent in the present litigation will be exempted under Section 14 of the Limitation Act in case the appellant/plaintiff chooses to file a suit for possession. 3.
Liberty is given to the appellant/plaintiff to file a suit for possession in accordance with law and in such suit the respondents/ defendants will have rights to raise all defences of facts and law, as available to them.

The appeal is accordingly disposed of in terms of the aforesaid consent order.
