O R D E R

% 14.07.2016 By this petition the petitioner seeks parole on the ground that he has to file special leave petition before the Supreme Court challenging the order of this Court upholding the conviction and arrange funds for the same. Application of the petitioner was dismissed by the State vide communication dated 16th February, 2016 primarily for the reason that the release would adversely affect the law and order situation and there could be harm to the victim party/witnesses and the petitioner is likely to jump the parole or commit similar offence, if released on parole. A perusal of the nominal roll of the petitioner would reveal that he was granted bail for nine months during the trial and during the pendency of the appeal also he was granted bail for 15 days. There is no allegation that he misused the said concession or threatened the victim or any other W.P.(CRL) 921/2016

witnesses. The petitioner has roots in the society and his family is residing at the address mentioned in the petition. Considering the facts and circumstances of the case, I deem it fit to grant parole to the Petitioner. It is, therefore, directed that the petitioner be released on parole for a period of four weeks from the date of his release on his furnishing a personal bond in the sum of `15,000/- with one surety of the like amount, subject to the satisfaction of the learned Trial Court.

Petition is disposed of.

Copy of the order be communicated to the petitioner through Superintendent, Tihar Jail.
