The present contempt proceeding has been referred to this Division Bench pursuant to the order dated 9th October, 2024 passed by Ms. Sukhvinder Kaur, learned Principal Judge, Family Courts, Patiala House Courts, Delhi and contempt reference dated 24th October, 2024 addressed from the said Court to the learned Registrar General of this Court. 3.

The principal allegation against the Contemnor is that he had misbehaved with the Court during proceedings in the case, HMA 108/22 and M. No. 39/2023 titled, 'Brig. Vijendra Singh Joon v. Neelam Joon Nee Neelam Dhanker'.

Vide order dated 9th December, 2024, the Respondent/Contemnor-Mr. Prashant Jain was called to show cause as to why contempt action ought not to be initiated against him. He firstly tenders an unconditional apology and submits that his only concern is that the application under Section 24 of Hindu Marriage Act, 1955 ought to be decided by the Court.

The Respondent-Contemnor is a lawyer and is also suffering from a serious medical condition for which he is undergoing treatment. He submits that he usually has never faced any such allegations of contempt and he has always behaved well before the Courts.

He further submits that he may have to undergo some major procedure next month for treatment of his condition.

After having perused the order by which the contempt reference has been made and after considering the unconditional apology, which has been tendered today and the medical condition of the Respondent, the Court takes a compassionate view of the matter and accepts the apology of the Respondent.

The Respondent, who is a lawyer shall ensure in future not to indulge in any such aggressive behaviour in the Court. 10.

The proceedings are closed and the contempt notice is discharged. 11.

In view of above, matter is disposed of accordingly. PRATHIBA M. SINGH, J.
