% 09.08.2016 IA No. 9543/2016 This is an application filed on behalf of the defendant, inter alia, praying that the order dated 27.01.2016 be modified and the order dated 04.04.2016 be set aside. It is seen that the order dated 27.01.2016 was a consent order. Thus, without the consent of the plaintiff, the said order cannot be modified.
For the same reason, the defendant's application for enlargement of time for making the payment was also dismissed on 04.04.2016. I find no reason for setting aside the aforesaid order. The above application is misconceived and is, accordingly, dismissed. IA No.9544/2016 This is an application seeking condonation of delay in filing the application (IA No.9543/2016).
