The learned counsel for the appellant submits that as the appeal under Section 13 of the Commercial Courts Act, 2015 would not be maintainable, he prays for leave to withdraw the present appeal with liberty to approach the appropriate forum in an appropriate proceeding.

The appeal is accordingly disposed of as withdrawn with liberty to the appellant as prayed for. The pending applications are also disposed of.

All pleas of the appellant shall remain open in any such proceedings taken by the appellant.
